General terms and conditions

1. Premise

These general conditions of sale have as their object the regulation of the purchase of products and services, carried out remotely and made available, through the www.cashmerewool.it in compliance with the Italian legislation referred to in Legislative Decree 206/2005 and subsequent changes and additions known as the "Consumer Code ".

The user who accesses the Site to make purchases is required, before sending the order, to carefully read these General Conditions which have been made available to him on the Site and which will be available for consultation at any time.

Contracts concluded with Cashmerewool through the Site are governed by these General Conditions in compliance with Italian law.

The language available to conclude the contract is Italian.

2. Choose and order the Products

The characteristics and price of the various products on sale on the Site are shown on the page relating to each Product.

To purchase the Products, the online Purchaser must complete and send the order form in electronic format, following the instructions contained on the Site. The online Purchaser must add the Product to the "Cart" and, after having read of these General Conditions, of the Privacy Policy and having confirmed their acceptance, he will have to enter the shipping data, any billing data, select the desired payment method and confirm the order.

By sending the order from the Site, which has the value of a contractual proposal, the online Purchaser acknowledges and declares to have read all the information provided during the purchase procedure and to fully accept these General Conditions and transcribed payment.

The contract stipulated between Cashmerewool and the online Buyer must be considered concluded with the acceptance of the order by Cashmerewool. This acceptance is communicated to the online Buyer via an order confirmation email containing:

  •  a reference to these General Conditions;
  •  the order number;
  •  shipping and billing data, if any;
  •  the list of Products ordered with their essential characteristics;
  •  the total price, including delivery costs.

Once the order has been received, if one or more Products are not available in stock, within 24 hours Cahmerewool will send a timely communication via email to the online Purchaser who, within the following 12 hours, will have the right to respond to:

  •  confirm the order without the unavailable products
  •  modify the order by replacing the unavailable products with other products
  •  cancel the order completely

In case of no response within this period, the order will be considered confirmed and the available Products will be shipped. In this case, the entire amount relating to the missing Products will be reversed or in any case, based on the chosen payment method, will not be charged to the online Purchaser.

3. Product Information

The information and characteristics relating to the products offered (descriptive sheet) are available together with the photographic image of each product. It is understood that the image of the products themselves has the sole purpose of presenting them for sale and may not be perfectly representative of their characteristics and qualities but may differ in color and size.

The information relating to the Products provided through the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors for which Cashmerewool cannot therefore be held responsible, except in the case of willful misconduct or gross negligence.

Cashmerewool reserves the right to correct errors, inaccuracies or omissions even after an order has been submitted, or to change or update information at any time without prior notice, without prejudice to the online Buyer's rights under these General Conditions and the Consumer Code.

Except for willful misconduct or gross negligence, any right of the online Buyer to compensation for damages or the recognition of compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or things, caused by non-acceptance or evasion , even partial, of an order.

 4. Method of payment

Product prices are inclusive of all taxes and duties . All prices are expressed in Euros

The online Purchaser can pay the price of the Products ordered and the related delivery costs by PayPal, Bank Transfer, or Cash on Delivery

In the case of payment via PayPal , once the order has been confirmed, the online Purchaser will be redirected to the relative site where he can make the payment in compliance with the relative conditions.

In the case of payment by bank transfer, the online buyer must make the transfer within 3 days from the date of the order.

If this does not occur, the order will be canceled and the goods made available again for purchase by other users. The online Buyer who has not proceeded to make the transfer may be contacted by Cashmerewool in order to clarify whether the cause of the non-credit is due to the online Buyer's will not to confirm the purchase or to other causes.

Reason: the online Buyer must indicate the date and order number in the reason for the transfer, which can be found in the confirmation email.

 5 Billing of orders

If the purchase is made by a professional, it will be possible to request an invoice by selecting the appropriate box during the order procedure and entering the billing information including the tax code and/or VAT number.

In this case, the invoice will be sent via email to the address indicated. The professional is responsible for entering the billing data correctly and is expressly informed that, if the invoice is not requested during the order phase, it will not be possible to request it later.

 6. Warranty and lack of conformity

The legal guarantees provided for by articles 129, 130 and 132 of the Consumer Code apply to the sale of the Products. the online Purchaser has the right, at his choice and on condition that the type of Product permits it, to restore, without charge, the conformity of the Product by means of repair or replacement, or to an adequate reduction of the price or to the termination of the contract. the online Buyer forfeits these rights if he does not report the lack of conformity to Cashmerewool within two months from the date on which he discovered the defect.

 7. Complaints

Any complaint, such as for example in the case of lack of conformity of the delivered products (as per point 6 of this document), the online Purchaser must immediately contact Cashmerewool by registered letter with return receipt to the following address:

Cashmerewool undertakes to respond to all requests received within a maximum of 7 working days.

 8. Right of withdrawal

The online Purchaser has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, except for the cases of exclusion provided for in point 10 below.

To exercise this right, the online buyer is required to inform Cashmerewool of his decision through an explicit declaration within 14 days from the date of receipt of the Products.

This declaration may be exercised through a communication sent by registered letter with return receipt , addressed to:

If the online Purchaser intends to exercise the withdrawal before having received the Products, the notice of withdrawal may be sent at any time before their receipt.

 9. Effects of withdrawal

If the right of withdrawal is exercised, the online Buyer must return the goods received, without undue delay, within and no later than 14 days from the day on which Cashmerewool was informed of this decision: the shipment of the returned goods must be sent, together with a copy of the purchase invoice, to the address

the Products must be returned in the same box in which they were received and the costs of the relative shipment, unless otherwise agreed between the parties, are borne by the sender

In this case, the online Buyer will be refunded within 14 days. from the date of receipt of the notice of withdrawal, all payments that he has made to Cashmerewool including delivery costs

These refunds will be made using the same means of payment used by the online Buyer for the initial transaction, unless expressly agreed otherwise; In the event of a bank transfer, the online Purchaser will be responsible for providing the bank details on which to obtain the refund (account holder, name and address of the Bank and IBAN). In case of payment in cash on delivery Cashmerewool will make the refund to the current account indicated in the return request made by the buyer

In any case, the online Purchaser will not have to incur any costs as a result of this reimbursement

 10. Conditions for exercising the Right of Withdrawal

a) The right does not apply if the online Purchaser is not a consumer and therefore, for example, has requested the sending of an invoice.

b) The right applies to the Product purchased in its entirety; therefore if the Product is made up of several components or parts it is not possible to exercise the withdrawal only on part of the Product purchased.

c) the law does not apply in the case of products made to measure or clearly personalized;

d) the right does not apply in the case of products that risk deteriorating or expiring rapidly

e) in the case of sealed products that do not lend themselves to being returned for hygienic reasons or related to health protection or that have been opened after delivery.

In cases of exclusion of the right of withdrawal, Cashmerewool will return the purchased Products to the online Purchaser, charging the shipping costs to the Purchaser.

 11. Applicable law and jurisdiction

The sales contract between the online buyer and Cashmerewool is understood to be concluded in Italy and governed by Italian law.

For the solution of disputes relating to the interpretation, execution or resolution of these General Conditions or individual purchase orders, if the online Buyer is a consumer pursuant to the Consumer Code, the court of his municipality will have exclusive jurisdiction of residence or domicile if located in the Italian territory; in all other cases, the territorial jurisdiction is exclusively that of the Court of BIELLA: any other competent court is expressly excluded.
